If an MSB customer is cashing checks(below $1000)they dont have to register with FinCEN, if they are an agent for a money transmitter they dont have to register with FinCEN...but if they do both are they then required to register?

You have no MSB activity triggering the requirement to register as an MSB. Whether they have to register with the state is a state law issue.
