From time to time, different posters have asked questions to which the answer stated "this should be referenced in your deposit agreement." Our signature card references "...the by-laws, rules and regulations... governing deposits...", but there is no such thing (other than the E, CC, DD & privacy disclosures), so I have asked to draft a deposit agreement.

I have tried to search the forums to compile a list of the content items that should be in a deposit agreement, but I know that there are items that were discussed but I haven't found. Could some of you deposit specialists out there help me out, or should I just recommend that we invest in a vendor's canned deposit agreement and tailor it to our needs?

Some of this may depend on which state you are in. What state are you in? If multiple states, you may need multiple agreements.

Well, ComplyGuy, I would start by going to the competition and getting copies of theirs. Then, you could check websites and see if anyone has theirs available there.

Or, if your profile had more information, maybe someone would "take pity" on you and e-mail or FAX one to you.

You want to review vendors offering this type of product as it really depends on your state laws how you tailor this agreement. I do like that a vendor does give you a compliance guarantee with forms as an example the vendor, Bankers Systems.

I do suggest you review vendors websites as you may get what information you need. I also suggest you look at all aspects in developing this document as it is not an easy task.

We use Bankers System, Inc. (BSI) Account Processor plus soon to change to BSI Arta Deposit. The account agreement produced by BSI is very good. Contatct BSI and they will send you a sample. Jason Jones BSI 1-800-397-2341 Ext 5075 be sure to request a sample for your state.
