Is this disclosure required on a consumer non-RE secured revolving LOC (overdraft protection) even if we don't offer credit insurance for that type of loan?

WE don't offer insurance on our HELOC's and don't provide the disclosure. Been thru 2 FDIC exams following this procedure and no comments from examiners.
