MSNNow: A black man is suing Walmart for $1 million in damages, claiming he suffered emotional distress while he was shopping at a store in Washington Township, N.J. On March 14, 2010, a voice came over the PA system announcing: "Attention Walmart customers: All black people leave the store now." A manager quickly took control of the microphone and a 16-year-old boy was later arrested for the prank. Donnell Battie's lawyers claim the megastore was negligent and reckless in allowing the incident to occur, and that he suffered from a number of psychological disorders as a result.

However, apparently Walmart did not have proper controls in place to prevent said teenager from accessing the PA system and make the announcement. . . .
Therefore, would they not be liable?

The same kid could have simply stood in the middle of the checkout registers with a megaphone and accomplished almost the same result. You can't regulate every action all the time. Would this gentleman prefer being escorted in and out of the store by federal mandate (all customers, to ensure that they behave and do not speak out of turn) and pay for that service? What a baby. I think I'll sue our local convenience store for allowing a certain young man to crank up the music in his car while it is unattended and he is inside paying for his gas. It is offensive music, and I suffer the emotional distress of having to keep myself from keying his car or stealing his keys and throwing them in the street or decking him as he walks out the door. Same premise. I could argue that because I am white and he is black, he purposely left his rap music loud to offend me. Must be EZ Go's fault.

The 16 year old and his family probably dont have a dime. Walmart on the other hand is loaded! If you are going to sue for a bull carp reason, you sue the rich guy! SHeesh!

What are the chances a judge orders Wal-Mart to have multi-factor authentication for their PA system? Then they will have to train their employees to protect and not share their PA passwords.
