Isn't there a requirement to send a 45 day notice prior to foreclosure action on a consumer who has given the lender a mortgage?

Check your documents as they may define some requirements and state laws.

You'll have to make sure that letters were sent when they should have been, telephone contacts are documented as well as correspondence and partial paymets were either refused or cured.

The federal requirement for pre-foreclosure notices has sunsetted. The notice was for homeowners counseling. Without that requirement, the only thing you should be concerned about is state law.
