Do banks that have customers who just use the night depository for dropping off bags with no keys, just zipper bags, to sign a night deposit agreement? Also what if customer just drop-off bags at teller windows to be processed during banking hours, should we have signed agreements on file as to who is authorized to pick up the bag, and should those individuals be require to sign for the bag even if they are only picking up the bag with deposit receipt inside,(no cash)?

Night drop agreements are designed to ensure all parties understand their rights and responsibilities. Without such an agreement, the bank is assuming undue liabilities associated with the service. Part of the responsibility rests with securing deposits in some type of bag that would show evidence of tampering (locked bag or tamper-proof plastic bag approved by the bank).

If an allegation of impropriety should arise, the bank will have little to nothing to show a judge. I vote "no agreement = no service". I would contact commercial clients and require agreements be executed.
