Q: Can we peel off our ATM surcharge notice now?

A: Don't be so quick. Although the federal law may have changed, many states have a state law requirement that you include the ATM surcharge notice on the ATM as well as the on the screen.

Does Iowa require the posted notice despite the federal law?

A CU, Where Regs Don't Apply
I have seen nothing indicating Iowa is subject to this. CUNA (CU trade association) published a list not long ago of states it applies to, found here indicates that states that require both disclosures are:

Requires both, placard and electronic display:
Illinois
Nebraska
Nevada
New York
Vermont
Wyoming

That being said, you may want to try to verify it with the IBA. We are leaving ours on, since we have plaques that are screwed into the machines and just figure we may as well leave it and just stop verifying that it's still there on a regular basis like we had been.

Iowa does not have a law that requires the signage to be present. I recently had a meeting at the IBA offices and we discussed this. Most of the banks in the meeting were leaving the notices on the machines. Many banks and myself included feel it is better to notify the user before they start the process.
