Have a situation where a customer is upset about a possible privacy breach. Occurred several months ago, but the customer is now threatening to see a lawyer after a recent loan denial.

Here is the scenario. Customer with a new checking account; which was not being handled well. Bank returned a check NSF to a local merchant. Merchant called about collecting on the check. Loan officer told merchant that a check for that amount would not cleared, and would not have cleared for some time, rather than simply stating that it was not good at this time. No dollar amounts were stated.

This conversation was not handled according to protocol, but my question is how much liability does the bank have in a situation such as this? There was no financial loss to the customer. Merchant collected on the check with the help of the county attorney several months later, and this checking account was closed with a -$500 balance that is still owed by aforementioned disgrunted customer.

Admittedly, the loan officer said more than was prudent but I can't see where this "customer" has a legal leg to stand on. Did you mention to them that they owed the bank $500.00? Sounds like a disgruntled non-customer. wink
