If local law enforcement is coming in asking for ATM photos, does that require a Subpoena?

I believe they are working on a case regarding a stolen credit card. They know who the individual is. The individual is not a customer of ours.

Since the bank is not involved in this case, then I would not release any bank records (i.e., photos) without a subpoena.

Thank you! That is what I suspected. It's just every time we tell them we need a subpoena, they grumble. I wanted to be sure I'm not asking unnecessarily.

It's interesting that they grumble. They should know that if they want the evidence to be admissible in court that it must be properly obtained.

Sometimes a piece of inadmissible evidence is used to "convince" a suspect his goose is cooked so that he will confess. But I agree, require a subpoena unless your bank is the party aggrieved by the transactions.
