We have an employee that has been on FMLA and will continue until their 12 weeks ends Jan. 10. They have used all paid time and are currently off without pay. Since our policy doesn't say otherwise I'm guessing we will have to go ahead and grant them their 2014 paid days on Jan. 2nd as normal even though they haven't been working. We are thinking of changing our policy to state that if you are on leave Jan. 2 then your upcoming paid days will not be granted until your return to work. Anyone have a similar policy or dealt with similar issues that can offer advice?

Our hourly employees don't accrue time when on leave, but you could ask if they want to use their vacation time for this week instead of going unpaid, then they won't have as much to use up when they get back.

our policy has us accruing leave on a monthly basis, so if you get 10 days a year you acrue .8 days per month...while we may allow you to take these days before earned, if you resign or are teminated prior to achieving the number of days taken you are docked pay for them on your last check.

if you are on leave at the beginning of the year, acrual of days starts on your return.

We do accrue vacation days while on leave.
