The subject property appears to be a residential structure that has been used as a law firm for decades, and currently limited to office space.

A request was submitted to refinance the mortgage on the property. Would the fact that the property is being used entirely for commercial use, make it "non"-HMDA reportable?

Yes. It's current use is not as a dwelling, therefore it wouldn't be reportable as a dwelling.
