If a bank charges a credit card late fee or returned payment fee based on "costs" - the bank must reevaluate the fee at least every twelve months - Correct?

The alternative is to use the "Safe Harbor" fees ($25 / $35) that are changed based on the CPI - then no reevaluation is required.
