Are any of you doing this? We began charging the fee about 3 years ago. We are trying to respond to complaint about the charge. My question is - does anyone remember anything about the court ruling that cleared the way for banks to charge the fee. It may have been a consumer group that brought an injuction. We want to refer to that ruling in this complaint response and I can't find my file on the issue. Thanks.

In 2001, there was a state law passed against charging a fee for a noncustomer to cash an on-us check, but it was overturned in federal court as being preempted by federal law. The injunction you are thinking of was actually brought by a group of banks against the state from enforcing the law against charging a fee for on-us checks cashed by noncustomers. You can charge the fee.
