Can we pay LOs differently for a refinance of a loan we are already servicing (on our balance sheet) compared with a refinance of a loan some other bank is servicing (not on our balance sheet)?

My first question would be why do you want to pay them differently? What's the reasoning?

I'd like to know that one too. I don't think the why is important. My guess would be that you could limit the compensation per loan but it would have to be the same % as the external referral.
