Here is an application that has the monitoring information filled out either by the applicants or the loan officer(not sure which). It was a face to face interview and the co-applicant is clearly a male, but the application says female. The HMDA sheet shows the co-applicant to be a male. Since those do not match, can the application be fixed to the correct sex or do we have to go by what the application says, whether it is correct or not? Hope this makes sense. smirk

Unless the loan officer completed based on observation, and that should be clear from documentation or discussion, I would leave it. The applicant could be in process of a sex change, or view himself as a she...and that is not your call..

Agree with KB.

We had one seem like a mis-mark. GMI had female name marked as male. Processor changed it on the HMDA-LAR to female (because applicant was her pregnant neighbor). Even after explanation regulator said "female" was incorrect, and when applicant marks it down, bank's only responsibility is to transcribe correctly what applicant said.
