Please help to settle a discussion here...what disclosures (both early and final) are required for Home Equity Lines of Credit?

All HELC transactions would require a HELC booklet and disclosure, and a early truth in lending open end disclosure. Other disclosures might be necessary depending on the type of transaction.

In addition to Poppy's list, be sure to provide a rescission form and monthly statements.

Jack, what are the requirments for the monthly statements. Is an interest due statement enough or must there be account activity detail?

Not sure what an interest due statement includes but you need to list the transations as well as several other items. See Attached 226.7 for details

My HELOC checklist also includes a Required Provider Disclosure, Affiliated Business Disclosure, Credit Insurance Disclosure (Required in Oregon if Credit Life is offered - I'm not sure about other states) Credit Score Disclosure, Flood Insurance Notification (if applicable), and Copy of Appraisal notice in addition to the other disclosures previously mentioned.

The required provider disclosure is a requirement of 3500.7, which as long as a lender provides the borrower with the disclosures required by 12 CFR 226.5b of Regulation Z (early HELOC) at the time the borrower applies for such loan, the lender shall be deemed to have satisfied the requirements of that section.

The rules have not changed with regard to a required provider list not being needed on HELOCs (as long as the initial early HELOC disclosure is given), correct?
