Bank customer John Smith gave his banker a list of the owners of some townhomes that are near the branch. Apparently he got the names because he has all the contracts with the townhomes (I'm not exactly sure what that means).

The banker would now like to use that list to do a direct mailing advertising our mortgage products.

This raises red flags to me, but I'm not sure if I'm just being overly cautious.

Any advice?

I think that would fall somewhere into pre-screening and those rules...but I'd also venture to say the customer has no right to divulge presumably private information, nor the banker to receive it.

I don't think it is any different than going on-line to: http://www.whitepages.com/neighbors
and typing an address.

Generally that type of information is public. If so I would not have any heartburn with it.

I thought that at first, but I have a feeling these owners are investors so finding their address may not be that simple?

It depends. Whoever last purchased the property can usually be found by looking up the address on a site like the one Rocky posted, or one like blockshopper.com. If the investors formed an LLC to purchase the property, then the names of the members might also be found by looking up that LLC on your secretary of state's website. Sometimes that information is very public.
