I'm looking for the exact wording of the requirement to provide a written list of service providers that the consumer can choose from.

I believe it was part of the new RESPA rules around 2010, but I can't find it in Regulation X. I found it in Reg Z, but the language it's in (1026.19(e)(1)(vi)(C)) doesn't take effect until 8/1/15. I need a regulation citation that's current today.

What am I missing?

From Appendix C:

. . . the loan originator must provide the borrower with a written list of settlement services providers at the time of the GFE, on a separate sheet of paper.

This is for ALL RESPA COVERED LOANS, correct? Even if you know at the time of the early disclosure, the Provider is on our list, you would still send this w/the disclosures. At least that is how I understand it.

If you don' t give a list of providers than it's assumed that everyone is on your list so 10% tolerance no matter who the borrower picks. Far better to give a list with one name so anyone else picked takes cost out of 10% block.

Where might I find guidance on whether the bank can refuse a customer's selected settlement agent, for title services, due to previous negative performance with us from that agent. Thanks in advance.

Go to p.14 of the FAQ as I referenced above. #2 says that the borrower may chose a QUALIFIED provider that is not on the list. You get to make the call as to whether the provider is qualified or not.
