Dumb, dumb, dumb question. Seriously. That's why I'm posting it on the 'anonymous' site. I have my reasons for asking. Go ahead, laugh all you want... laugh

Is the Protecting Tenants at Foreclosure Act of 2009 still in effect? Everything I've read states that it expired December 31, 2012.

Public Law 111-22-May 20, 2009 states:

SEC. 704. SUNSET.

This title, and any amendments made by this title are repealed, and the requirements under this title shall terminate, on December 31, 2012.

From the CFPB's website: The Protecting Tenants at Foreclosure Act expires on December 31, 2014.

I don't recall hearing anything about this since, oh, about 2009. Maybe it's just other more public issues that have taken the attention but I have not heard of an extension.

According to the CFPB's site, there is mention in a Mortgage article on 8/8/2014 that "The Protecting Tenants at Foreclosure Act expires on December 31, 2014. This summary will be updated if the Protecting Tenants at Foreclosure Act is extended by the United States Congress."

So I guess we'll all stay tuned to see if Congress decides to extend it...

There was a bill introduced but it is just sitting there are the moment. The current sunset date is actually an extended date.

I am not aware of any action on this. A cautionary note: It might be a good idea to continue whatever you have been doing to comply with this law, simply because the next Congress could decide to revive the protections in spite of the sunset provision in the 2009 law.
