If we email a consumer our electronic consent form containing all of the required information - and ask that the form be printed, signed and returned by email, are we acquiring the necessary e-consent upon return of the form?

What types of documents are you switching from paper to electronic delivery? Are you using the same e-delivery technology for all types of e-documents? How are your customers supposed to print a form on paper and then email it back to you...must all customers have a scanner?

Unfortunately, ESIGN has no such definition--the demonstration must be a test drive of whatever document e-delivery system you have created. The first step in testing any demonstrable consent process is to acquire a thorough understanding of that system, and the OP hasn't told us anything about his/her system.
