If a elderly person requests a loan to pay the taxes on a lump sum he was told he will be recieving which based on all the details he has told us sounds to be a scam can we deny the loan based on possible elder abuse?

As long as the bank is not denying the loan because of a prohibited basis, it is the creditor's choice. IMHO, the customer is most likely going to go elsewhere unless you get your (city/county/state) elder abuse department on it. The customer will not believe you over getting thousands of dollars.
