Concerning a Phase I exempt customer that is a listed public company or subsidiary. Do they have to maintain the guidelines for exempt status. Meaning 5 or more cash deposits a year. If they do not meet the 5 deposits a year they come off the exempt status. Is that correct.

Subject: Guidance on Determining Eligibility for Exemption from Currency Transaction Reporting Requirements

The DOEP filing and annual review are still required for businesses listed on a major national stock exchange ("listed businesses"), non-listed businesses, and payroll customers.

Yes - the annual review is required to ensure they are still a listed company, but they don't have to conduct 5 or more transactions a year.
