Is there any kind of disclosure or verbiage that needs to appear in an email to customers? Our Marketing Department is preparing an email to be sent to customers if they have provided us an email address. The purpose is to thank them for joining our email list. Nothing is being sold or offered. It mentions our on-line banking and our mobile banking app. It further says the bank does not request personal or banking information via email and they are not to respond to the email. If they have any questions or wish to contact the bank, there is a tab at the top of the email that they can click on. E-banking is a new area for our bank and we are being very cautious. Thank you for your time.

CAN-SPAM defines and regulates two types of emails:
- transaction or relationship messages (communications with existing customers relating to the products they currently use)
- commercial e-mail messages (communications with anyone about anything other than existing accounts and relationships)

Disclosure and opt-out apply to the second category but not the first. This information from the FTC provides a good overview of C-S. You might also check your regulator's exam manuals to see how this topic is covered by examiners.
