I have a duplicate deposit question and what our remedy might be in situations like these.

Last year, a customer (now a former customer) mobile deposited a check into her accout at our bank. This check was drawn on another bank who paid the item. The customer later closed her account with us. This same customer then went into the bank the item was drawn on nearly a year later and cashed the item. This bank then returned the item to us because the customer intiatlly deposited the item at our bank via mobile deposit. We have no way to charge the item back to the customer because they are no longer in our system.

Is there any remedy available for us? Could we have/ can we return the item?

Unless I'm missing something, I fail to understand why this is your problem. I would return it as account closed. The item was drawn on them and they should've recognized it as a duplicate, no?

i'm with Doug - how is an item written on and cashed at their bank returned to you?

They returned the item to us as a duplicate item with the reason being that since it was deposited at our institution via mobile desposit, we are responsible for securing the item. We attempted to return it as account closed, but it was again returned to us.

The paying bank's lack of an effective duplicate presentment detection system is not your problem. When they cashed the check, payment was final (for the second time). They deserve to be stuck with the check.

Any recovery will depend on their going after the party at fault -- your former customer -- directly.
