Our Bank made an HPML loan on property and a mobile home. We did escrow for this loan. A few years later, the customer built a house on the same property and we financed it and it was an HPML loan so it was escrowed as well. We should not have escrowed for this second loan of the financing of the house because our mortgage was a second mortgage..behind the mortgage we did when we did the mobile home loan. In addition, the customer no longer lives in the mobile home and it is rented. We would like to cancel one of the escrow accounts. Can we cancel the escrow account associated with the mobile home since the mobile home is no longer the primary residence? If not, would we be able to cancel the escrow account on the second mortgage since it was not required to have escrow in the first place? And, if we are able to cancel one of the escrow accounts, are there customer notification requirements?
