Our deposit operations department is updating an informational piece that we give to our business deposit account customers. It contains the following paragraph:
"We have partnered with <name of check printing company>, our trusted provider, to offer personal and business forms that meet our standards. <name of check printing company> guarantees that you will be completely satisfied with every purchase. This “Satisfaction Guarantee†isn’t a statement – it’s a promise — and they will go to great lengths to make good on their word. In addition to guaranteeing your satisfaction, <name of check printing company> guarantees your privacy and security (be aware that many discount check providers do not secure your privacy and in fact sell your personal information). To order checks and forms, call 800.XXX.XXXX or go to their website, nameofcompany.com."
I think this paragraph goes too far in promoting a particular vendor, but I'm wondering if there's a compliance argument that I can take back to deposit operations. I maintain there's a risk in promoting this company's guarantee and that we could be held liable if they fail to perform. What other pitfalls should we consider? By the way, we get a spiff for each product this company sells to our customers.
