In light of that fact, the spouse will not be residing there which would mean that we do not have to have them sign off on the necessary documents correct?

If you're in WI, you've got marital property issues to deal with beyond just the fact that the spouse may or may not be on title. I 'd be calling my FI's legal counsel on this one.
