Our customer is set up on positive pay and several counterfeit checks have come in this week from out of state and we have sent them back as "altered/fictitious." Neither the bank nor the customer have taken a loss and we will not take a loss from these. What would be the benefit of our customer filling out an affidavit of forgery for these checks? If they do, who would need them?

Typically, you would ask your customer to complete an affidavit of forgery prior to reimbursing them for any items paid over a forged signature. Since your bank did not pay any of the bogus items, there is no need for your customer to make a claim against the bank.

I think there would be very little need, if any at all, to collect an affidavit.

We only collect affidavits for items that were paid. If caught timely and returned we do not ask for an affidavit.
