We were having discussions on the new overtime rules and tracking work done after regular hours. The question came up concerning a non-exempt employee being out of town at a school or conference. Suppose they are in class 8 hours each day and once they are back to their hotel they begin working on texts and emails from their office. Seems as if someone at a week long school could end up getting overtime pay for that week. Is this correct or are we missing something?
We do not allow non-exempt employees access to work email outside of the office. Because, yes, if they are working after an 8 hour class then those hours would be OT.
