Elderly customer says that he gave his debit card to someone in order to purchase groceries for him. Customer reviews his account and there are numerous ATM and POS transactions that he didn’t authorize. (He wrote his PIN on the card because he has a bad memory). All transactions were completed when the “someone” still had possession of the card. Do we have to give provisional credit under Reg E, and does he have any liability?

You can deny the claim, unless you feel sorry for the old guy. Maybe he shouldn't have a card.

2(m) Unauthorized Electronic Fund Transfer

2. Authority. If a consumer furnishes an access device and grants authority to make transfers to a person (such as a family member or co-worker) who exceeds the authority given, the consumer is fully liable for the transfers unless the consumer has notified the financial institution that transfers by that person are no longer authorized.

Also, you need to report the perpetrator to your State's elder abuse hotline.
