So ... I got blindsided by a question so I decided to see what everyone else thinks.

Would a loan to purchase a (or refi for that matter) a boat slip be subject to TRID?

I don't think a boat slip meets the definition of real estate.

Would TRID apply to boat racks that are over dirt? The racks will be condominiumized.

Currently we have an application for the purchase of a boat slip that is condominiumized and has a alt key/parcel ID on our country property records. Would this be a TRID covered loan?

I think John answered this above. Condominiumized or not, a boat slip doesn't meet the definition of real estate under TRID. It's not a dwelling and it's not attached to real estate.

My answer was offered a couple of years ago. Since then I've had time to think about how far the definition of "real estate" might go. Your best response above is Randy Carey's -- Is it considered real estate under state law?

This is really a State specific law issue and you should probably ask a real estate attorney in the State in question. In most States, the State actually owns the land under the navigable waters.
