(205 ILCS 5/48.1) (from Ch. 17, par. 360)


Does the Illinois Banking Act section above, prohibit an Illinois Bank from sharing a customer's name and address with a company like Elan, where there is a joint marketing agreement to market to the banks customers a bank credit card, even if there is an opt-out on the privacy notice?

You are correct, IL is an opt-in state. That is why at the Bank I used to work at, WE did the mailing out.

We are an IL bank and have recently been asked to do this. Is this still not allowed in IL? I would have thought the credit card company would have known this and not even approached us with it.
