I love HGTV until it comes to compliance! Have any of you had the "opportunity" to finance a tiny home? If so, how did you handle it? On the one hand, you may have someone who has some land and will "park it" permanently on that spot, but the other hand holds a tiny home that will be mobile. We have had a request to finance a home made tiny home that will remain on the trailer on which it was built and be mobile. Thoughts? Help!

I guess my first sentence was misleading. This is not a regulation question, but a question of perfecting the lien if not tied to RE or titled. In the case of; built at home, not purchased from a builder.

That would be a question for your attorney as it may vary in all 50 states and probably some counties/cities too.

And it won't likely be a 'mobile home' by definition even though it is mobile. Chances are it will not have the HUD seal of approval and even the square footage probably is too low.

Chance are it will be secured by UCC, but as Rocky said...this is a topic for legal...

We just had an inquiry on tiny home financing too. It will be their primary dwelling, but as stated in an earlier post, probably doesn't meet the regulatory definition of a mobile home. Would it be more like an RV secured loan? May not be titled as an RV, but secured by UCC.

Sometimes there may be nuances and it would be probably better for an attorney to opine for your exact circumstances. I would hate to put my job on the line for something that I learned on a public forum.
