Customer has been using debit card to authorize wires through Western Union and buying money grams at Walmart. Finds out she is being scammed. Filed a police report and now wants the bank to refund money to her account. Not for sure what is being disputed but want to make sure I am not missing something.

If they were authorized, she needs to look toward someone other than the bank for a refund.

In a case like this, should we have her fill out a dispute form and then as part of our investigation inform her that it was authorized. Is this a case where a dispute would be filed?

A customer is free to make a claim under Reg E for any electronic funds transfer which they did by providing an oral notice. In this instance, you investigation will be brief:

"The consumer admits to authorizing Western Union to charge their card $XXX.XX and the account was charged for the correct amount. This does not meet the definition of an electronic funds transfer error."

Since you already know the outcome of your investigation, there is no value in asking the customer to complete paperwork. Simply provide written notice to the customer that no error occurred as required by 1005.11(d) and move on.
