We have a loan that we wrote up as an exception - Seller did not sign the same HUD the borrowers signed. The attorney had the seller to sign a separate HUD because of confidentiality reasons. Is this true?

Yes. I don't see an issue with that... Plus, the regulation doesn't state anywhere that we are required to have signatures or signatures on the same HUD. I'm second-guessing myself today.

Correction: We don't know if the two HUDs are identical. We don't have the HUD that the seller signed. The attorney refused to give us a copy due to confidentiality reasons.

A HUD form - as in a HUD-1? What type of transaction are you talking about?

Wow! That's throwback Thursday terminology! If the loan is subject to TRID, that attorney had best check out his law degree. The lender must be provided a copy of the seller's closing disclosure.

Can I tack onto this thread? Is the requirement that the title company or settlement agent must send the bank a copy of the seller's disclosure that THEY provided at settlement?

No it's not a dumb question. If the settlement agent provides the seller closing disclosure as required by 1026.19(f)(4)(i), using a document that's separate from the borrower's disclosure provided by the lender, the settlement agent "shall provide to the creditor (if the creditor is not the settlement agent) a copy of the disclosures provided to the seller under paragraph (f)(4)(i) of this section."
