Would a structure that is being used as a halfway house or transition home for homeless folks be considered a residential dwelling for the purpose of determining the maximum coverage. Or would that be a non-residential structure?

Sounds like a residential structure to me. However, without knowing all of the details, this is really a question for the insurance agent - how will the agent classify it?

It does say non-residential on the insurance. Would we be able to dispute that with the insurance agent if we believe that it is a residential structure?

You should, if you believe is is incorrect. I would ask the agent why they classified it as non-residential. Maybe that's right. Maybe not.

It's also possible these structures may be classified as other residential. I would be more inclined to attach that classification depending on the building's make-up. You'll have to make the determination based on the information you have.

Other Residential Building. A residential building that is designed for use as a residential space for 5 or more families or a mixed-use building in which the total floor area devoted to non-residential uses is less than 25% of the total floor area within the building.
