Are we required to accept an e-check without micr printed on the bottom of the check from our customer?

please define "e-check". by this do you mean the customer uses a bill pay (or some other 3rd party) provider to create a physical check on their behalf and send to your bank to pay on a loan or for deposit on account?

The customer presented a Deluxe e-check they printed as per instructions on plain white paper, validate the bank numbers are centered and clear, and to deposit like normal after endorsing it. Sys if your FI has questions to say that the check was printed from an authorized check record. It is not a Check 21 Image Replacement Document and they can verify by visiting e-checks.com/verify or call 800/631/8962.

also it has a 'signature' that is electronic and not similar to the customer's signature.

Accept? as in accept for deposit? You don't have to accept anything for deposit that you don't want too.

If this check is accepted, what regulatory disclosures if any, would be involved? This time the check was brought into the bank and the customer asked about it. The check was electronically signed.

Why would there need to be any disclosure?. I owe you $100 - I go to Deluxe and sign up or whatever you do (I didn't read the whole FAQ document) and Deluxe debits my account for $100 and I get to send you an e-mail that contains the $100 check. You take it to your bank. Your bank either accepts it for deposit or they don't.

MICR is an old standard. Still. most checks have their "MICR line" printed in MICR ink. But it's not a requirement for negotiation. Many banks process checks through a machine that can read those characters using OCR technology when the MICR ink isn't used. And once the item makes it through the imaging stage, the MICR ink is irrelevant. I look at the DeLuxe e-checks as no more risky than most of the checks your bank receives for deposit -- if you can process them.
