we want to run an ad comparing our home loan rates to the average national rates.
our rates would include the APR but the average national rates are rates only, no APR...is that a problem?

Simply my opinion: It's misleading. Comparing apples to oranges. That could be seen as deceptive - a UDAP issue. Plus, wouldn't your APR's be higher than the interest rates? That doesn't seem like a good comparison for you to make.

of course our problem is that it is very easy to find national rates but they don't come with the corresponding APRs.
do you think it would be ok for us to compute the APR ourselves?
