Banker-12, it may be advisable to create a flow chart of your SOP denoting where E-SIGN requirements are met just to demonstrate an understanding of what is done, and why.

A flow chart is an excellent idea. Since the necessity for ESIGN is the "in writing" requirements of other federal laws & regs, be sure to include details explaining the trigger(s). Also, this is a good place to make note of the records you will need to defend yourself if customers (or regulators) challenge your ESIGN consent at a future date.
