Need advice....we have a lender at a branch that will sometimes not send a loan to be booked for over a month. Sometimes the customer's first payment comes due before the loan is even on the books. The compliance department has addressed the issue with management for the last several years and this is still occurring. We know there are several issues with allowing this to happen. Our loan policy states that the loans shall be sent and booked no later than 5 days after consummation. Does anyone have any advice??

Is this a part of your employee review/performance evaluation process? If not, I'd make sure that failure to comply with internal policies is written up in officer's HR files and start working on either getting officer to comply or it negatively affecting his review so that it can be documented for termination. You do not want willful negligence to come up in a regulatory exam.

How far up the food chain have you taken this issue? To Executive Management and the Chief Lending Officer?

If you have and they aren't making the loan officer follow the bank's policy, then I am not sure what to tell you.

Has the bank received any complaints from customers concerning this issue?

This happens once, it should be a warning and monitoring, twice...goodbye. But like the others said, if you're not getting support from management, that's a whole other issue.

Exactly. If management doesn't do anything about this and doesn't seem to care, then this is a bad situation with no easy solution.

That's pretty egregious negligence. This has been going on for over a year? I'm assuming that means more than once or twice during that time period. Document your efforts to correct in your CYA file and start polishing your resume.
