I have seen a lot of previous threads about when institutions fail to give the Right of Rescission documents when they were actually supposed to, but what about when an institution treats a loan like the Right of Rescission applies, but it actually doesn't? Does the fact that the notice and the wait for funds occurred, create a de facto legal situation?
