I'm reviewing a flyer that promotes an open house. The address of the open house is listed, but no where on the flyer is the realtor noted. Since a specific realtor is not noted, would this flyer be exempt from any potential RESPA Section 8 violations? Your help is greatly appreciated!

From what you described, the bank is promoting an open house for a realtor, regardless of whether or not the realtor's name is included on the flyer. So it appeasrs you are providing something of value to the realtor in exchange for referrals.

I'm not sure how the flyer could be exempt from a potential RESPA Section 8 violation. If the Realtor gets anything of value (directly or indirectly), you could have potential Section 8 issues.
