The owners title insurance is a typical seller paid fee in our area. Since this fee is seller paid, are we allowed to not disclose on the loan estimate?

Well, you can leave it off if you want to - but then you are going to have to lower the seller's credit for the portion that is going to be credited to the amount that you have disclosed for the lender's policy. The calculation seems complicated enough without adding more hoops. It just creates more opportunity for error.

Just to clarify, if the lender does not show the owners, but they quote the full lenders premium, are they allowed to show the title adjustment on the loan estimate?

37(h)(1)(vi) Seller credits.

2. Seller credits for specific charges. To the extent known by the creditor at the time of delivery of the Loan Estimate, specific seller credits, i.e., seller credits for specific items disclosed under § 1026.37(f) and (g), may be either disclosed under § 1026.37(h)(1)(vi) or reflected in the amounts disclosed for those specific items under § 1026.37(f) and (g).

I cant find it at the moment, but while searching for whether or not certain fees had to be disclosed, I read somewhere that Owner's Title technically needs to be disclosed on the LE regardless of who is paying for it. Transfer Tax for instance and other fees can be left off, but I think Owner's Title has to be. Thats why it comes with the worth Optional.


But it's a section H Fee. I dont think anybody will give you any trouble over it.

but technically speaking, I do believe it needs to be disclosed.
