At one time (some 20+ years ago since I've dealt with it) Ohio had a special disclosure that was required to be given to Ohio residents at the time of application for residential mortgage loans. I have spent the better part of 2-3 hours doing Google searches trying to find if this disclosure is still required and to find a sample of the disclosure. I have had no luck.

1. Is this disclosure still required under Ohio statutes?

2. If so, does it apply to all Ohio residents regardless where the property is located or does it only apply to Ohio residents where the property is located in Ohio?

3. If it is required for all Ohio residents regardless where the property is located could you please provide me with a sample disclosure?

4. If the requirement is still required what are the penalties, if any, and/or the remedies if the disclosure was not provided?

I seem to recall this had something to do with Ohio ECOA statutes and I also want to say this disclosure was incorporated into a 1003 specifically for Ohio.

Any help you can give me would be greatly appreciated.

Dan - are you referring to this?

OH Rev Code Section 4112.021(B)(1)(g) Fail or refuse to print on or firmly attach to each application for credit, in a type size no smaller than that used throughout most of the application form, the following notice: "The Ohio laws against discrimination require that all creditors make credit equally available to all credit worthy customers, and that credit reporting agencies maintain separate credit histories on each individual upon request. The Ohio civil rights commission administers compliance with this law." This notice is not required to be included in applications that have a multi-state distribution if the notice is mailed to the applicant with the notice of acceptance or rejection of the application.
