Recently married female applicant applies for consumer auto loan, bank obtains copy of her current DL (which includes her new married name). Bank proceeds to pull credit report on this applicant, only to find that the agencies have no record of her new married name, her credit file still includes only her maiden name. Is bank within its rights to obtain a copy of this applicant's marriage certificate for identification purposes to ensure we are in fact dealing with the same woman...any ECOA/FCRA issues with requesting this? If so, then how should this type of situation be handled? Thanks.

You have proof with the current DL showing her new married name. That's all you need.

It will not support until the Credit Bureaus updates her information. Also, she had to have her marriage license to get her new DL. If you feel more comfortable, then I would ask her for a copy.

credit reports are not supportive documentation of names. Actually, getting her old DL would be more of a supporting doc for what's on the CBR than anything else. But why make her jump through hoops? She got married and changed her name on the new DL and gave you her maiden name. That should be sufficient.
