We have a customer that we suspect is the target of elder financial abuse by a "caretaker". We were told today that she would be depositing a cashier check for approx. $20,000 from a CD she has at another local bank by the "caretaker" The customer appears to have dementia and the "caretaker" brings her in and speaks for her and conducts her transactions. This has been reported to APS today. Is there any type of hold that can be placed on the $20,000 for the entire amount until APS starts their investigation.

Not under Reg CC there isn't and if you start injecting the bank into these situations, you open yourself up for legal issues of your own if you start bouncing checks. If you don't want to be party to the situation, don't accept the check for deposit.

Check your state laws. Minnesota recently had some financial exploitation of vulnerable adults legislation that became effective that allows extended holds to be placed if abuse is suspected.

Agree with Sarah, check your state laws.

In WA we can do a five day hold on an account if we suspect financial exploitation of a vulnerable adult. RCW 74.34.215 for anyone that is curious or for me later when I need the citation again. laugh
