Hi, quick ? We are a small nonprofit, but are regulated and licensed by MA Division of Banks. We also are a CDC and a CDFI. Anyways, question would apply to any financial institution: if we had extra office space that we could rent out, do we need to be concerned about implied relationships, such as if we rented to an attorney, a realtor, an investment group, or even an insurance agent?

Any arms length transaction should not create a problem. And of course, being cautious that every thing going forward remains as such.

You joined the Forum 5 years ago and this is your first post? Don't be such a stranger. :-)

Questions like this can be directed to your state regulator. All you would be asking is whether or not that agency would take exception with a specific practice if it was discovered during an examination of your institution. It's not a request for permission--simply an attempt to learn what's legal, ethical, or a "best practice." When I was a regulator (many moons ago) we looked favorably on bank management that made an effort to be proactively compliant.
