If an estate is not required and an order to dispense is issued, does the person named in the order to dispense have the same exact rights that an executor would?

Situation-Mom passed away, daughter was named in the order to dispense and is now requesting 2 years worth of bank statements? There was a different joint owner and the account was closed. We would provide this information to a named executor but there wasn't one. The are saying that their attorney told them the order to dispense means they can get whatever they need.

Never had anyone with an Order to Dispense to ask for anything other than a check!

Assuming we are talking about KY again. The order to dispense most likely is worded as follows:

Upon verified petition of the above petitioner, IT IS HEREBY ORDERED that the petition be granted to dispense with the administration of the estate of the above decedent, and the above personal property is transferred to petitioner or his/her designee,

If they want anything but the current personal property in your possession, I think they would need a subpoena.

You really need to be talking to your legal counsel however.
