Our mortgage servicing department presented the following situation to me.

On a non- escrowed FNMA mortgage, the borrowers are 60 days past due on their most recent tax payment. The borrowers are non-English speaking.

Servicing would like to force an escrow for taxes. Is there any reason to discourage this? I have already raised Fair Lending as they could have to implement this practice across the board for everyone.

Pull out the FNMA servicing guide and refer to Chapter B-1, Escrow Account Administration.

I surely hope that they are following the FNMA guidelines in every situation.
