We of course want to assist Local Law Enforcement on a scam case. If Police want film, and copies of ID's, and Copies of a CTR. Is it proper to release any of these without a subpoena? Transactions were from non-customers. Otherwise I would get a customer release.

We would typically furnish the documents if the bank was the victim in the case and that would be my only exception to the rule. I'm not sure what benefit a CTR would be, but I probably wouldn't provide that to local enforcement anyway, all information surrounding the transaction would be available to them with a subpoena.

Yes, I agree if the bank was the victim, then that would be no problem. But you would also provide CTRs if you received a subpoena for them.

On multiple occasions I've had law enforcement reach to me for CTRs; sometimes connected to SAR subjects (but unrelated to the filed case) and sometimes not. I've also had them be very pushy when I've advised them they need a subpoena.

My question is, do they not have a way to access or request those documents from FinCEN? They often know the CTR was filed without me saying anything, so why aren't they just going through their channels?
